Terms and Conditions
Terms:

  1. Any and all transactions between BRO San Diego and its customers are subject to these terms and conditions.
  2. Materials shall be paid in advance and prior to commencement of any work.
  3. Payment forms include money order, cash, company check and debit/credit card, apple pay. Card transactions will be subject to a 3% convenience fee.
  4. Final payments shall be due for each vehicle within two (2) days of installation and completion.
  5. Customer agrees to pay all costs of collection in the vent of default of payment by Customer, including reasonable attorney's fees and costs. In the event of delinquent payments, the Customer shall be charged a rate of 1.5% per month. Venue for any dispute regarding the enforcement of this agreement shall be Sacramento, California.
  6. Customer agrees that any additional work or materials not specifically set forth in the invoice are an extra which shall be billed and charged by BRO San Diego at its regular prices including, but not limited to, hourly rates for labor and services of $105.00 per hour and costs for goods and materials at costs plus twenty percent. Customer agrees that it shall pay for all extras billed and charged by BRO San Diego within days (10) of invoice and subject to a late charge of 1.5% per month.
  7. The terms of this invoice are good for a period of ten days at which time if not accepted shall be subject to change.
  8. All invoices and agreements are subject to the accompanying General Terms and Conditions.

GENERAL TERMS AND CONDITIONS

1. Condition of Vehicles for Wrap Installation.
Customer agrees to have all vehicles delivered for
wrap installation at Customer's sole costs and expense, damage free, washed, dried and in a ready to install condition.
Neither BRO San Diego nor its designated agents or subcontractors shall be responsible for any damage sustained to any vehicle prior to delivery. Any damage sustained to a vehicle prior to delivery will be noted by BRO San Diego and/or its designated agents or subcontractors upon delivery and such damage will excuse and invalidate the warranty provided by BRO San Diego. Customer shall be responsible and bear the risk of all loss for any vehicle prior to delivery. If a vehicle is delivered to a designated location in a damaged condition, Customer shall have the vehicle repaired or replaced, at its sole discretion, and its sole costs and expense. BRO San Diego shall have no obligation to install any wrap upon a damaged vehicle unless instructed by Customer to do so otherwise in which case Customer waives and releases BRO San Diego from any warranty provided herein. If a vehicle is not delivered to the designated location in a washed, dried and ready to install condition, BRO San Diego shall charge, and Customer shall pay to BRO San Diego, an additional extra charge of $100.00 per vehicle that requires washing and drying prior to installation.

2.Artwork.
BRO San Diego is not responsible for errors in spelling, color, or design in regards to any and all artwork submitted by the client to BRO San Diego. It is assumed that all artwork submitted to BRO San Diego by the client has been approved by client prior to submission and is production ready.
All artwork created by BRO San Diego will be submitted to client via a digital proof for approval. Prior to any printing all digital proofs must be approved by signature and returned to BRO San Diego via fax, mail or email.
Upon approval, BRO San Diego will not be held responsible for any errors or omissions in regards to spelling, color or design.

3.Appearance and alterations.
Client understands that the product purchased is a vehicle color changing wrap(or paint protection wrap - clear or matte vinyl). It is
also understood that unlike a paint job on a vehicle, there can and will be seems, and patches that are necessary to cover entire vehicle and it's contours and irregularities. It is also understood that upon approval of final graphic proofs, some changes to the finalized artwork may be necessary at time of installation to allow the vehicle wrap to fit the vehicle's shape. Client understands that the use of overlaied decals and contour cut decals are used when necessary. Client authorizes BRO San Diego to make such necessary changes.

4. Paint condition and failures.
BRO San Diego is not responsible for paint failures due to spray paint, uncured paint, bad or defective factory paint jobs, or any paint that peels, cracks, or chips durring the course of the wrap installation.

5. Down Time and On-site Installations.
In the event that an on-site installation is scheduled by the
client, any and all down time will be billed at $110/hour. All client specified installations will be subject to approval based on location, weather, and availability. Any and/or all aspects of client installation location that do not meet 3M's warranty standards will be subject to a loss of warranty of product and installation.
All on-site installations will be documented on a 3M approved warranty sheet.

6. Pickup of Completed Vehicles.
Customer shall pick up and take delivery of any vehicle when the
services provided BRO San Diego has been completed at its sole costs and expense. Customer shall bear all risk of loss for any vehicle after completion of the wrap installation. Any vehicle not picked up after completion they vehicle after 72 hours will be subject to an additional charge and storage fees in the amount of $75.00 per day.

7. Cancellations, returns and refund.
Vinyl material is a non-returnable item once the material is installed. All graphic art work and any ordered vinyl material for any projects is paid by the customer a nonrefundable deposit of 50% of the amount specified in the invoice, is first part of required before we ordered product. Once vinyl is installed all sales are final and there is no refunds. If an issue arises the customer must submit their complaint in writing and give BRO San Diego the opportunity to see the issue and try and resolve the issue prior to pressuring any legal actions. Since all wrap installations are customized to the customers specifications BRO San Diego must be given the opportunity to address any issues, including removal and re-installation time (if deemed necessary by BRO San Diego), before the Client issues a credit card chargebacks or check cancellations.


8. Indemnity by Customer.
Customer agrees to indemnify and hold BRO San Diego harmless form any and all claims, causes of action or damages caused by Customer and/or its agents or subcontractors including reimbursement of reasonable attorney fees and costs.

9. Severability.
In the event any portion of a provision of this agreement is deemed to be invalid or unlawful, the remainder of such provision and all other provisions shall remain in full force and effect and binding upon the parties.

10. Counterparts.
This agreement may be signed in any number of counter parts including by way of facsimile and all of which shall be deemed an original and one in the same.

11. Integration and Amendments.
This agreement constitutes the full and final understanding of the
parties. The parties agree that there are no other agreements or understandings by and between them except as reflected and memorialized in this agreement and that they are not relying upon any other oral statement or understanding outside of this agreement to enter into same. This agreement cannot be modified or amended unless agreed to in a writing signed by the parties.

12. Time is of the Essence.
Time is of the essence for each and every performance required under this agreement. The waiver of any timely performance or obligation required under this agreement shall not constitute or be deemed a waiver of any right to demand or require timely, prompt and compliant performance in the future.

WINDOW FILM – TERMS AND CONDITIONS

GENERAL TERMS AND CONDITIONS, TERMS OF PAYMENT, LEGAL FEES, AND DISPUTES: The customer agrees to make full payment prior to the release of the products or vehicle. The vehicle or products will not be released until full payment has been processed accordingly. By accepting the product or vehicle you are accepting the job as complete and that the performance is satisfactory. You are responsible for inspecting the product and or vehicle upon receipt. Customers must contact BRO San Diego of any and all work in dispute, accompanied by written explanation. After investigation, if an error is found on our behalf we will make appropriate corrections.
BRO San Diego is not responsible for loss or damage to vehicle or articles left in vehicle in case of fire, theft, accident or any other cause beyond our control.

PAYMENT TERMS: Customer agrees that they are the responsible party for payment of services requested. Customer agrees to make full payment prior to vehicle release. Any custom ordered materials for the customer’s job is required to be paid for 100% prior to the order for the film before the work will be performed and are non-refundable. Any custom ordered window film for any project is paid for by the customer 100% prior to ordering the product. A fee of 3% will be charged for any credit card pay, in addition to the amount due.

CONDITION OF GLASS PRIOR TO WINDOW FILM INSTALLATION: BRO San Diego is not responsible for the condition of the paint surface and glass the car. Any existing on glass scratches, cracks or other damage will be visible through the film, and such surface damage or imperfections may damage the film, cause the film to fail prematurely or the window film material may not adhere to the surface at all. We are not responsible for broken windows during installation if there is prior damage prior. WE AR NOT RESPONSIBLE FOR THE CONDITION OF THE GLASS/VEHICLE PRIOR TO THE WINDOW FILM BEING INSTALLED OR WHAT IS UNDERNEATH THE WINDOW FILM ONCE IT IS INSTALLED.

RETURNS: Window film material is a non-returnable item once the material is ordered, cut and or installed. Any custom ordered window film for any project is paid for by the customer 100% prior to ordering the product. If the job is cancelled or the customer does not want the product for any reason the film cost is non-refundable. All returns are at the discretion of BRO San Diego. If an issue arises the customer must submit their complaint in writing and give BRO San Diego the opportunity to see the issue and try and resolve the issue prior to pursuing any legal actions. Since all window film installations are customized to the customers specifications BRO San Diego must be given the opportunity to address any issues, including removal and reinstallation. In the event that the client does request a credit card charge back or check cancellation, the customer will be liable for all legal fees and or additional costs that were incurred to BRO San Diego. If a credit card dispute is decided in the favor of BRO San Diego and we suffer any losses due to the client’s actions the client is liable for all legal fees, court costs, etc. If the customer fails to make full payment on an invoice then the customer authorizes BRO San Diego to remove the window film from the windows if installed.

"SINCE WINDOW FILM IS CUSTOM INSTALLED TO THE CUSTOMERS SPECIFICATIONS ONCE THE FILM IS CUT AND OR INSTALLED ALL CONTRACTS ARE FINAL AND NO MONETARY REFUNDS WILL BE ISSUED."

INSTALLATIONS: Window film is a pliable material that is made to be installed on glass. We make every effort to make look as clean and seamless as possible, however, there may certain surfaces that window film will not adhere to such as plastic, rubber, dot matrix, etc. and customers are not advised to install on such areas. If the customer requests that these areas be installed we are not responsible for the material not sticking or adhering to those surfaces and the manufacture will not warranty such items.
Per the IWFA (International Window Film Association) The glass with applied films shall be viewed at right angles to the glass from the room side and at a distance no less than six (6) feet. Viewing shall be carried out in natural daylight, not in direct sun light. The installation is deemed acceptable if all of the following are unobtrusive (effects during 30 day cure time should be disregarded). Dirt Particles, Hair and Fibers, Adhesive Gels, Fingerprints, Air Bubbles, Water Haze, Scores and Scratches, Film Distortion, Creases, Edge Lifting, Nicks and Tears. If any of these conditions still exist after 30 days we request the customer return at such time to have us evaluate the film.
WE CANNOT DO AN INSPECTION OVER THE PHONE, VIA EMAIL OR THROUGH PICTURES; WE MUST SEE THE VEHICLE/GLASS AT OUR LOCATION FOR INSPECTION.
ONCE INSTALLED WINDOW FILM MATERIAL IS INTENDED TO BE VIEWED FROM A DISTANCE OF SIX (6) FEET FROM THE GLASS AND IS DEEMED AS ACCEPTABLE.

While we make every effort to get the film as close to the edges as we can, when window film is installed there may be slight gaps. This allows for the water used in the installation to be squeegeed out. This also ensures that the film edges are not raised up by contact with the frame margin, dot matrix or other moldings, etc. Contact with the frame, dot matrix or moldings can lead to peeling of the film. A gap may also exist due to the type of glass or windows that the film is installed on, which BRO San Diego is not responsible for.

WINDOW FILM COMES IN MANY DIFFERENT SHADES, COLORS, AND OPTIONS AND IS SELECTED SOLEY BY THE CUSTOMER AND IS INSTALLED AT THEIR REQUEST. BRO SAN DIEGO IS NOT RESPONSIBLE FOR THE CUSTOMERS CHOICE IN FILM SELECTION OR FOR BUYERS REMORSE.

Installation time is based upon many factors including but not limited to, film selected, curing time, places where window film is being installed, size of windows, size of vehicle, complexity of installation areas and any unforeseen circumstances that may arise. We will make every effort to give reasonable time frames for instillation but reserve the right to change them at any time for any reason.
In most cases bubbles and haziness will subside in the 30 day cure time. We DO NOT require a 30 day check-up for window film. However if you see any areas of concern please return to our location with the vehicle so we can see the vehicle first hand and to be able to address any issues at that time. If you do not return within the 30 day required time frame to address any issues we are not responsible for the condition of the window film material or any installation issues. BRO San Diego is the installation company only we are not the manufacture.

REMOVALS: All removals for window film are quoted separately and are based on a per hour basis. Window film removal can be very time consuming and costly and is billed as such. BRO San Diego is not responsible for the condition of the glass underneath the film being removed or for any damage that occurs when such material is removed from the glass/vehicle. BRO San Diego is not responsible for any damage that occurs to the vehicle at the owner’s request.

WARRANTY AND MATERIALS: All materials are installed per the customer or authorized representatives request. We are not the manufacture of the product and all warranties are offered through the manufacture of the product the customer specifically ordered. For warranty information you must visit the manufacture website or brochure for specific information regarding the product(s) you ordered. BRO San Diego is the installer of the product, not the manufacture. However, if there is something wrong with the product our manufactures do stand behind their products as do we, so please do not hesitate to contact us. Damage done to the film by the customer or any third party is not a warranty issue and will not be covered as such. BRO San Diego is not liable for services that are contracted out to other facilities for work to be performed. If an issue arises the customer must contact that specific company directly for any warranty issues or concerns regarding that companies product or services.

AFTER CARE: Do not roll the windows down for the first 3-5 days after film is installed. You will see bubbles and haziness (the moisture between the glass and the film) in the windows until the film has fully cured. This can take 30 days depending upon the type of film you select and the environment your vehicle is stored in. Avoid using abrasive washing clothes as well as drying towels when cleaning the film. Do not use any ammonia-based products to clean the film, only use tint safe products.

VEHICLE STORAGE FEES: Vehicles left beyond the authorized pickup day (definition of authorized pickup day: is the date vehicle is ready to be picked up and the client has been notified) will be charged $75.00 per day, per occupied space, until the vehicle or vehicles have been picked up and paid for.

VEHICLE MAINTENANCE/TOWING/TRANSPORTATION, ETC.: BRO San Diego is not responsible for the vehicles maintenance, condition or any mechanical malfunctions that may occur when the vehicle is in BRO San Diego possession. If a vehicle needs to be repaired or taken to a repair shop / dealership for any reason, including but not limited to: maintenance, recalls, electronic malfunctions, parts, etc. BRO San Diego is not responsible for any of the costs and is the owners sole responsibility to pay for those costs.

BRO San Diego is the installation company only we are not the manufacture.

REMOVALS: All removals for window film are quoted separately and are based on a per hour basis. Window film removal can be very time consuming and costly and is billed as such. BRO San Diego is not responsible for the condition of the glass underneath the film being removed or for any damage that occurs when such material is removed from the glass/vehicle. BRO San Diego is not responsible for any damage that occurs to the vehicle at the owner’s request.

WARRANTY AND MATERIALS: All materials are installed per the customer or authorized representatives request. We are not the manufacture of the product and all warranties are offered through the manufacture of the product the customer specifically ordered. For warranty information you must visit the manufacture website or brochure for specific information regarding the product(s) you ordered. BRO San Diego is the installer of the product, not the manufacture. However, if there is something wrong with the product our manufactures do stand behind their products as do we, so please do not hesitate to contact us. Damage done to the film by the customer or any third party is not a warranty issue and will not be covered as such. BRO San Diego is not liable for services that are contracted out to other facilities for work to be performed. If an issue arises the customer must contact that specific company directly for any warranty issues or concerns regarding that companies product or services.

AFTER CARE: Do not roll the windows down for the first 3-5 days after film is installed. You will see bubbles and haziness (the moisture between the glass and the film) in the windows until the film has fully cured. This can take 30 days depending upon the type of film you select and the environment your vehicle is stored in. Avoid using abrasive washing clothes as well as drying towels when cleaning the film. Do not use any ammonia-based products to clean the film, only use tint safe products.

VEHICLE STORAGE FEES: Vehicles left beyond the authorized pickup day (definition of authorized pickup day: is the date vehicle is ready to be picked up and the client has been notified) will be charged $75.00 per day, per occupied space, until the vehicle or vehicles have been picked up and paid for.

VEHICLE MAINTENANCE/TOWING/TRANSPORTATION, ETC.: BRO San Diego is not responsible for the vehicles maintenance, condition or any mechanical malfunctions that may occur when the vehicle is in BRO San Diego possession. If a vehicle needs to be repaired or taken to a repair shop / dealership for any reason, including but not limited to: maintenance, recalls, electronic malfunctions, parts, etc. BRO San Diego is not responsible for any of the costs and is the owners sole responsibility to pay for those costs.
